Anti-dumping and countervailing duty petitions filed

The American Glass Packaging Coalition has filed anti-dumping and countervailing duty petitions on imports of certain glass containers from China. The coalition filed the petitions on behalf of Anchor Glass Container Corp, Ardagh Glass Inc and a third unidentified petitioner.

The US anti-dumping law imposes special tariffs to counteract imports that are sold in the United States at less than ‘normal value’, while the US countervailing law imposes special tariffs to counteract imports that are sold in the USA with the benefit of foreign government subsidies. For AD/CVD duties to be imposed, the US government must determine not only that dumping and/or subsidies are occurring but also that there is ‘material injury’ (or threat thereof) by reason of the dumped and/or subsidised imports. Importers are liable for any potential AD/CVD duties imposed. In addition, these investigations could impact purchasers by increasing prices and/or decreasing supply of certain glass containers.

The merchandise covered by this investigation are certain glass containers with a nominal capacity of 0.059 litres (2.0 fluid ounces) to 4.0 litres (135.256 fluid ounces) and a mouth with a nominal outer diameter of 14mm-120mm. The scope includes glass jars, bottles, flasks and similar containers; with or without their closures; whether clear or coloured; and with or without, design or functional enhancements (including but not limited to handles, embossing, labelling or etching).
